9. Arbitration and Dispute Resolution

You agree to settle any dispute that arises according to the following dispute resolution process; and if necessary:

  • to settle any dispute by a third party Arbitration service

  • to waive your right to file any class lawsuit or pursue settlement by a court.

Dispute Resolution Process:

1 Negotiation and Good Faith Efforts:

  • If any dispute arises between you and the Company both parties shall first attempt to resolve it amicably through good faith negotiations.

  • Promptly notify each other in writing of any dispute and provide relevant details and expectations.

2 Mediation

If a resolution is not found within a reasonable and agreed upon time frame, either party may initiate mediation.

Both parties will agree to

  • Select a mutually agreed-upon Arbitration service to facilitate discussions.

  • The goal is to reach a mutually acceptable resolution.

3 Arbitration, Venue and Governing Law:

If mediation is unsuccessful or not pursued, any unresolved dispute shall be submitted to a binding arbitration.

  • Shall be according to the Laws of the Commonwealth of the State of Pennsylvania shall govern this agreement and any disputes arising from it.

  • Shall be in accordance with the rules of the American Arbitration Association (AAA) or another mutually agreed-upon arbitration service.

  • The arbitration shall take place in a mutually agreed upon location.

  • The arbitrator’s decision shall be final and binding on both parties.

  • Each party shall bear their own costs associated with the arbitration.

4 Exceptions

  • This dispute resolution clause does not apply to injunctive relief or actions seeking equitable remedies.

  • Either party may seek injunctive relief in a court of competent jurisdiction to prevent irreparable harm pending resolution through arbitration.

By continuing to use the Site, you acknowledge and agree to these Terms and Conditions stated herein.

If you do not agree to these Terms and Conditions, you are not permitted to use the Site.
